What is an Annotation in Land titles?

Annotations can include information about mortgages, claims or liens, restrictions, or pending legal actions. An annotation pursuant to Section 4, Rule 74 of the Rules of Court must be removed by the seller in order to deliver a clean condominium title or land title to the buyer. This annotation usually appears in the seller’s inherited property – be it land or condominium, or those who acquired the real property via extrajudicial settlement of estate or usually known as the transfer due to the death of a relative wherein, you as the titleholder, is the new owner of record as reflected on your condominium title or land title.

Why Annotate Your Property Title?

Title annotation is the process of adding official notes or comments to a property’s Certificate of Title. These annotations provide additional information or legal notes that may affect the ownership, use, or transfer of the property. Annotating property titles in the Philippines is essential for ensuring your property rights are fully recognized and protected. Whether you’re buying, selling, or transferring property, an accurate and up-to-date title annotation is crucial for:

  • Clear Ownership: Establish undisputed ownership and avoid legal disputes.
  • Smooth Transactions: Facilitate hassle-free property transactions.
  • Legal Compliance: Meet all legal requirements and protect your investments.
